GENERAL AND ORDERING TERMS OF HANSASHOP ® E-SHOP
1. Scope and validity of the terms
1.1. The terms and conditions apply to the legal relations between all persons and the owner of the shopping environment www.hansashop.eu (hereinafter e-shop) Borsa Eesti OÜ (registry code: 11138411, address: Haapsalu mnt 21, Keila, firstname.lastname@example.org) when purchasing products via the e-shop , among other things, the legislation in force in the Republic of Estonia also applies.
1.2. The user of the e-shop is a legal person or a natural person (who confirms by using the e-shop that he or she is at least 18 years old (hereinafter also a consumer)). By using the e-shop, the user confirms that he has read the terms and conditions and agrees and fulfills the terms and conditions correctly.
1.3. Borsa Eesti OÜ reserves the right to change and supplement these terms and conditions and the price list due to the development of the e-store and in the interests of better and safer use of the e-store. Persons will be notified of changes and additions to the terms and conditions and the price list via the e-store's website. Amendments and supplements to the Terms and Conditions and the Price List shall enter into force as of the publication of the respective amendment or supplement on the website www.hansashop.eu. If you submitted your order before the changes to the terms came into force, the terms and conditions in force at the time of submitting the order will apply, unless otherwise provided by law or these terms and conditions.
4.1. The prices of the products sold in the e-shop are displayed in euros and payment is made in euros.
4.2. All prices include 20% VAT.
4.3. The prices of the e-store are valid for the timely payment of the invoice in accordance with the provisions of clause 4.
4.4. The transport fee may be added to the price of the product indicated in the e-shop, which will be highlighted in the shopping cart at the time of choosing the mode of transport. The transport fee depends on the size and weight of the ordered product or the choice of postal service (Venipak courier, Itella SmartPOST parcel machine service, Omniva parcel machine service). The transport fee does not apply to the option "I pick up the goods myself" (Keila, Tartu).
4.5. The assortment and prices in the e-shop may differ from the assortment and prices in the stores of Borsa Eesti OÜ (Keila pet store, Tartu delivery point).
4.6. The prices shown in the e-shop are valid in the e-shop, the prices in the stores of Borsa Eesti OÜ may differ from the prices in the e-shop.
3. Shopping cart and ordering
3.1. To order the goods, you must add the desired products to the shopping cart. The shopping cart is created when you click the "Add to cart" button. By clicking on the "Shopping Cart" option, you will see your entire shopping cart with the amount to be paid.
3.2. You can change the number of products in the shopping cart. You can also change the quantity of products ordered. Click the "Update Cart" button to confirm the change. Click the "Go to pay" button to continue placing your order. You will be redirected to the subscriber details page.
3.3. On the customer data page, enter the required data, the desired delivery method and click the "Place order" button. You will be directed to pay.
3.4. Be careful when filling in the fields on the customer information and order confirmation pages, as the accuracy and correctness of this information depends on the fast and trouble-free delivery of the products you have purchased.
3.5. The contract for the sale of products is considered concluded (entry into force of the contract) as of the receipt of the amount payable according to the order confirmation to the current account of Borsa Eesti OÜ.
3.6. Orders placed in the e-shop are processed on working days (Mon-Fri 10.00-18.00). Also applies to the "I pick up the goods myself" delivery option.
4. Payment for Products
4.1. To make a payment, select the payment method you like on the ordering page.
4.2. The customer pays for the order in advance in full in the ways shown in the Hansashop e-shop. A service fee may be added to the cost of the order in accordance with the agreement concluded between the customer and the issuer of the bank or credit card. Payment is made outside the hansashop e-shop in a secure environment - when paying with a bank link, when paying with the corresponding bank and credit card in the secure environment of Maksekeskus AS. The seller does not have access to the customer's bank and credit card details.
4.3. The order will be canceled if the purchase amount has not been received in the current account of Borsa Eesti OÜ within 5 days.
4.4. In case of cancellation of the order or return of the purchased product, the purchase amount will be refunded according to the payment method selected when placing the order. The amount paid by transfer is transferred back to the account from which the paid amount was received.
5. Delivery and handover of products
5.1. After the entry into force of the Agreement in accordance with clause 3.5 of the Conditions. the products are delivered to the consumer by the delivery method chosen by him when placing the order:
- Itella SmartPOST parcel machine;
- Omniva parcel machine
- Venipaki courier;
- I pick up the goods myself (Keila, Tartu).
5.2. Shipments usually reach the destination specified by the buyer within 2-7 working days from the date of purchase. In exceptional cases, the right to deliver the goods within up to 45 calendar days.
5.3. The products together with the usage information in Estonian and other documents accompanying the products will be delivered by the courier company within the delivery term indicated on the product card and order confirmation.
5.4. If the product ordered by the consumer is not in stock and must be ordered from a special supplier and it is obvious that delivery of the product within the delivery term specified in the product description is not possible, and in other cases if timely delivery is not possible in circumstances for which Borsa Eesti OÜ is not responsible, we will notify the consumer thereof by contact telephone or e-mail notified by the consumer when placing the order within 5 working days as of the entry into force of the Agreement in accordance with clause 3.5 of the Conditions. and we also announce the delivery time of the ordered product. If, as a consumer, you lose interest in purchasing the product due to a longer delivery time, the consumer has the right to cancel his order (see sections 6.1 and 6.4 for more details) and the amount paid by the consumer (including transport costs) will be refunded. When ordering a product, we send a prepaid invoice to the consumer.
5.5. When the ordered products have been handed over to the transport company, the transport company will contact the consumer and state the time of delivery of the products.
5.6. The courier company delivers the products to the address indicated by the consumer when placing the order. It is not possible to change the destination later.
5.7. Please ensure that the contact details provided when ordering are correct to avoid delays and misunderstandings in the delivery of the products. Borsa Eesti OÜ and the courier company are not responsible for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy or inaccuracy of the information provided by the consumer when placing the order.
5.8. The products are handed over to the consumer by the courier together with the delivery note. Before signing the delivery note, we strongly recommend that the consumer inspect the packaging of the products and, in the event of external damage, make a note to that effect on the courier's delivery note. We ask the consumer to report a product with damaged packaging by e-mail to email@example.com or to the contact telephone number of Borsa Eesti OÜ: 627 7777. If necessary, the product with damaged packaging by the courier company will be replaced.
5.9. Delivery terms are valid only in the territory of the Republic of Estonia.
5.10. By choosing “I will pick it up myself” to receive the product, the product will be issued to the consumer on the basis of an identity document from Borsa Eesti OÜ Keila or Tartu office. A confirmation will be sent to the consumer by e-mail once the goods have been completed. Products ordered from the e-store will be delivered on working days in Keila Mon-Fri 10: 00-18: 00, Tartu R 12: 00-18: 00.
5.11. Used environmentally hazardous consumables required for use in the equipment sold by Borsa Eesti OÜ in the e-shop, such as batteries and accumulators, are accepted free of charge at the Borsa Eesti OÜ office (Haapsalu mnt 21, Keila). Large electronic waste must be disposed of at an appropriate collection point.
6. Withdrawal from the Agreement before the Service Provider performs the Agreement
6.1. If the Service User wishes to withdraw from the User Agreement after submitting the order and before the Service Provider performs it, the Service User undertakes to notify the Service Provider as soon as possible. The notice must be sent to the Service Provider's e-mail address firstname.lastname@example.org. The e-mail must indicate the order number from which you wish to withdraw and add the contact details of the Service user (first name, surname, date of order submission, contact telephone number).
6.2. If the withdrawal application reaches the Service Provider after the Service Provider has performed the User Agreement, the agreement shall be withdrawn in accordance with the chapter “Right of Return” of the User Agreement.
6.3. The Service Provider shall refund the amount paid to the Service User no later than within 30 days from the receipt of the request to withdraw from the contract.
6.4. The money is transferred to the same current account from which it was received by the Service Provider.
6.5. The service provider has the right to withdraw from the contract or cancel the contract if the stocks of the ordered goods are exhausted. The paid advance payment (s) will be returned to the current account of the Service User as soon as possible, but not later than within 14 days. The reason for the refund is stated in the bank's explanation of the refund payment order, no separate contact will be made.
7. Return of non-compliant products
7.1. In the case of consumer sales, Borsa Eesti OÜ is responsible for the non-compliance of the thing with the terms of the contract, which becomes apparent within two years from the delivery of the thing to the consumer. In the case of consumer sales, the lack of conformity which arose within six months from the date of delivery of the thing to the buyer shall be presumed to have existed at the time of delivery, unless such presumption is incompatible with the nature of the thing or defect.
7.2. The Buyer must notify Borsa Eesti OÜ (email@example.com) of the non-compliance of the thing with the terms of the contract within a reasonable time after he or she became aware or should have become aware of the non-compliance of the thing with the terms of the contract. In the case of consumer sales, the consumer must notify Borsa Eesti OÜ of the non-compliance of the matter with the terms of the contract within two months after becoming aware of the non-compliance.
7.3. Borsa Eesti OÜ is not responsible for:
1) due to the consumer's fault for deterioration / damage of the product;
2) for defects that have arisen as a result of irregular use of the product;
3) for normal wear and tear of the product during normal use.
7.4. In case of non-conformity or defect of the product, the consumer has the right to demand the replacement of the product with a compliant and defective product or to withdraw from the order and return the non-compliant product at the expense of Borsa Eesti OÜ.
7.5. In case of returning a non-compliant product, the amount paid for the product (including transport costs) will be transferred to the bank account provided by the consumer no later than 14 days after receiving the notice of withdrawal and request to return the product.
7.6. Persons engaged in economic and professional activities have the right to file a claim in relation to the product (s) within 5 working days from the receipt of the goods.
7.8. The e-shop responds to consumer complaints in writing or in a form that can be reproduced in writing within 15 days. Complaints can be submitted by e-mail to firstname.lastname@example.org
7.9. If a product defect occurs, provide the following information:
- name and contact details;
- order number;
- defect of the product (description of the defect, photograph).
8. Liability and force majeure
8.1. Borsa Eesti OÜ is liable to the consumer and as a consumer you are liable to Borsa Eesti OÜ for the damage caused to the other party by the violation of these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
8.2. Borsa Eesti OÜ is not liable for damages caused to the consumer or delay in delivery of the product if the damage or delay in delivery of the product is due to a circumstance which Borsa Eesti OÜ could not influence and the arrival of which Borsa Eesti OÜ did not and could not have foreseen (force majeure) .
9. Other conditions
9.1. Borsa Eesti OÜ uses the personal data entered by the consumer (incl. Name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the consumer. Borsa Eesti OÜ transmits personal data to companies providing transport services in order to deliver the goods.
9.2. Borsa Eesti OÜ sends newsletters and offers to the consumer's e-mail address only if the consumer has expressed a wish by entering the e-mail address on the website and has announced his / her wish to receive direct mail notifications.
9.3. The consumer can withdraw from the offers and newsletters sent to the e-mail at any time by notifying us by e-mail or by following the instructions provided in the e-mail containing the offers.
9.4. In matters not resolved separately in these terms and conditions, the legislation in force in the Republic of Estonia shall apply.
9.5. Borsa Eesti OÜ reminds that the consumer has the right to use the legal remedies set out in § 101 of the Law of Obligations Act (to demand performance of an obligation, to demand compensation for damage, to withdraw from the contract, etc.).
9.6. Disputes arising between the consumer and Borsa Eesti OÜ in connection with ordering and purchasing products via the e-store will be resolved through negotiations. If no agreement is reached, the consumer has the right to apply to the Consumer Disputes Committee (see www.k Komis.ee or in case of cross-border disputes: ec.europa.eu/consumers/odr/) or to the county court of the place of residence to protect their rights. The consumer may lodge a complaint himself or through a representative. Disputes shall be resolved in accordance with the legislation in force in the Republic of Estonia.
9.5. Disputes with economic and professional persons are settled through negotiations. In case of unsuccessful negotiations in Harju County Court.
10.1. Product images are for illustrative purposes only. The product description is of a general nature and may not include all features.
10.2. Product prices and availability are subject to change without notice. In this case, Borsa Eesti OÜ reserves the right to cancel the sale and return the money to the customer's current account within 10 working days.
10.3. Borsa Eesti OÜ reserves the right to cancel the sale if any of the following problems have occurred with the product: a human error has occurred in entering the price or a technical error in the system (For example, if the selling price of € 1,500 that the product is defective and that the product is not to be sold at that price).
10.4. Product information is checked and improved regularly. The data may have been updated since the consumer's last visit. Due to the lack of data cards from the manufacturers, there may be inaccuracies in the product information of the e-store. In this case, Borsa Eesti OÜ does not take responsibility for the accuracy of the product data. However, before making a purchase, we recommend that you check the accuracy of the product information, if possible, by calling our customer service on 623 3333 or by sending an e-mail to email@example.com.

12.1. It is obligatory for the Service User to get acquainted with the terms and conditions provided in the User Agreement.
1.3. Borsa Eesti OÜ confirms that the processing of the client's personal data is based on legality, fairness and transparency; purpose limitation and minimization; reliability and confidentiality; principles of fairness and retention.
1.4. Borsa Eesti OÜ confirms that it does its utmost to ensure the security and confidentiality of personal data and takes all measures to ensure the proper storage of such data.
2. Processor of personal data
2.1. The processor of personal data in the e-shop is Borsa Eesti OÜ.
2.2. Borsa Eesti OÜ processes personal data on the websites managed by Borsa Eesti OÜ (registry code: 11138411, address: Haapsalu mnt 21 76605 Keila, e-mail: email@example.com, phone: 627 7777).
2.3. In these terms and conditions, the e-shop of Borsa Eesti OÜ and the website operator "Hansashop" are mentioned.
2.4 Hansashop is the chief processor of personal data, Hansashop forwards the personal data necessary for making payments to the authorized processor.
3. Legal basis and purpose of the processing of personal data
3.1. Personal data is data that Hansashop collects for the purpose of fulfilling or contacting a customer's purchase or order.
3.2. The collection of customer personal data can take place in the following ways:

4. Personal data to be processed
4.1. All data on an identified or identifiable natural person shall be considered personal data. The personal data processed by Hansashop are:

4.1.2. Phone number;
4.1.3. E-mail address;
4.1.4. Postal address, delivery address;
5. Customer rights
5.1. The customer's rights with respect to Hansashop in relation to personal data are:
5.1.1. Request access to your personal data;
5.1.2. Request the correction of your personal data;
5.1.3. Request restriction of your personal data;
5.1.4. Request the deletion of your personal data;
5.1.5. Request the transfer of your personal data;
5.1.6. Withdraw your prior consent to the processing of personal data if justified;
5.1.7. Submit a complaint to the data protection supervisory authority (Data Protection Inspectorate, www.aki.ee, firstname.lastname@example.org).
6. Collection and use of non-personal data (aggregate data)
6.1. Hansashop collects non-personalized data as needed to improve the provision of goods / services by Hansashop to customers.
7. Submission of newsletters and offers
7.1. Hansashop will only send newsletters, promotions and special offers to the customer in connection with the products and services sold by Hansashop if the customer has given explicit consent (subscribing to the newsletter and actively ticking the consent box or a separate written request is also considered consent).
7.2. The customer has the right to withdraw this consent at any time (by giving up the newsletter or by submitting a corresponding application to Hansashop).
8.1. Hansashop takes all precautions (including administrative, technical and physical and other measures) to protect the customer's personal data. Only authorized persons have access to modify and process the data.
8.2. Hansashop confirms that it does not transfer customers' personal data to third parties without the customer's prior consent, unless the obligation to provide data arises from the customer's need to complete a sales transaction (eg providing an address to a courier) or provided by law.
9.2. Hansashop confirms that if the change should affect the customer's rights, Hansashop will inform the customer of the change and the customer has the right to decide whether to consent to the change or to refuse to use the service.
10. Contact details related to the processing of personal data
10.2. In connection with the processing of personal data, we also recommend that you visit the website of the Data Protection Inspectorate (www.aki.ee)
Upon receipt of the product (s), the consumer has 14 days to familiarize himself with the product (s). If for some reason the purchased product is not suitable for the consumer, the consumer has the opportunity to return the product or exchange it for another product within 14 days.
To return the product, you must fill in the return application form and send it by e-mail to email@example.com.
If the consumer does not use the return application form for return, please indicate in the return application:
- Order number;
- Date of receipt of the product;
- Name of the buyer;
- Name of the returned product;
- Current account number to whom and where the money is returned;
- Reason for leaving the product (optional)
The consumer must return the product specified in the return application no later than 14 days after the submission of the return application. The product can be returned to the store of Borsa Eesti OÜ (Keila), sent by courier: Borsa Eesti OÜ, Haapsalu mnt 21, Keila 76605 or use Itella Smartpost and Omniva parcel machines (phone: 5343 0023).
Please read the return conditions before returning the product.
The cost of returning the product is borne by the consumer, with the exception of in the following cases:
If the product is damaged which could not be detected by external inspection and which did not occur when the package was opened;
If the product does not match the product in the consumer's order (i.e. the wrong product was sent incorrectly).
The product must be returned in the original packaging. The product packaging must be opened carefully without damaging it. The returned product (including accessories) must be unused and undamaged. The consumer has the right to get acquainted with the product in the way that is normally allowed in the store, and the consumer is responsible for the decrease in the value of the product when inspecting the product if you have used the product in any other way. The returned product must be complete (include the product packaging and all items included in the product packaging - cables, user manuals, etc.). If the product has been purchased as part of a campaign where another product has been added to the product, you must return the entire set (ie all products).
The consumer does not have the right to withdraw from special products specially ordered for him. Purchased goods cannot be returned if the ordered product is made to order and taking into account the customer's personal needs or according to the conditions provided by the customer. (For example, tinted colors, cut-to-size products.)
We will refund the purchase amount paid for the returned product according to the payment method used to make the purchase within 14 days from the receipt of the notice of withdrawal, provided that you have returned the product within the same term, ie within 14 days.
If the product has been damaged during return or the product shows signs of use, Borsa eesti OÜ has the right to refuse the return or agree on compensation for the reduction of the value of the thing.
